Terms of Use for Vix AI

These Terms of Use (“Terms”) govern your access to and use of the Vix AI iOS application and related services (collectively, the “Service”). The Service is operated by Vix AI (“Vix AI,” “we,” “us,” or “our”).

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be able to form a legally binding contract in your jurisdiction to use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

2. The Service

Vix AI enables users to generate infographics based on inputs such as CSV files, PDFs, images, text, and topic searches. The Service may include export, templates, and a content history or library.

We may add, remove, or change features at any time, including features related to credits, subscriptions, output formats, or processing methods.

3. Accounts and sign in

To use the Service, you must sign in using Google Sign In or Sign in with Apple.

You agree to:

  • Provide accurate information where required.
  • Keep your device secure and protect your account from unauthorized access.
  • Notify us promptly if you believe your account has been compromised.

You are responsible for all activity that occurs under your account.

4. Subscriptions, credits, and billing

4.1 Weekly subscriptions and recurring billing

Vix AI offers weekly subscription plans (“Weekly Subscription”). A Weekly Subscription renews automatically each week unless you cancel it through your Apple ID subscription settings.

Renewal will occur in accordance with Apple’s rules, typically within 24 hours prior to the end of the current billing period. The subscription renews at the then-current price unless you cancel before renewal.

Deleting the App does not cancel your subscription.

4.2 Weekly credits and no rollover

Your Weekly Subscription includes a weekly allocation of credits (“Credits”) to use for generation features.

No rollover: Credits are granted for a weekly period and unused credits do not carry over. Any credits not used by the end of the weekly period expire and are replaced by the next weekly allocation (subject to successful renewal and entitlement validation).

The weekly expiry applies to subscription credits. Credits from one-time credit packs do not expire. Subscription credits are used before purchased credits.

4.3 Credit consumption and feature costs

Current credit costs are:

  • Standard infographic generation: 15 credits
  • Template-based generation: 20 credits, or 15 for a new user’s first creation
  • AI editing: 15 credits per operation

Applicable credit costs are shown in the Service at the time you initiate an action. By starting a generation, you authorize us to deduct the associated credits.

Credits deducted for a failed generation or edit are automatically returned to your balance.

4.4 No cash value, no transfer

Credits:

  • Have no cash value and are not legal tender.
  • Are not redeemable for cash.
  • Are non-transferable and may not be sold, traded, or gifted.
  • Are not refundable except where required by applicable law.

4.5 Cancellation

You can cancel auto-renewal at any time through your Apple ID subscription settings. Cancellation stops future renewals, and you typically retain access to subscription benefits until the end of the current billing period.

4.6 Refunds and billing issues

All purchases are processed by Apple. Refund requests are handled by Apple under Apple’s policies. We cannot issue refunds directly for purchases billed by Apple.

If you believe you were charged incorrectly or did not receive entitlements after a successful purchase, contact us and include relevant details from your App Store purchase history.

4.7 Changes to plans and pricing

We may change subscription pricing, weekly credit amounts, feature availability, or credit costs. Any changes will apply in accordance with Apple’s rules, including notice and consent flows where required.

5. User Content and permissions

5.1 Your content

“User Content” includes any content you upload, submit, import, or otherwise provide through the Service, including CSV, PDF, images, text, and topic inputs, and any generated outputs you save.

You represent and warrant that you have all rights and permissions necessary to provide your User Content and to grant the licenses in these Terms.

5.2 License you grant to Vix AI

You grant Vix AI a limited, worldwide, non-exclusive, royalty-free license to host, store (if applicable), reproduce, process, transform, and transmit your User Content only as necessary to:

  • Provide the Service and generate outputs you request
  • Operate subscriptions, credits, and entitlements
  • Protect the Service and prevent abuse
  • Troubleshoot, debug, and improve reliability

This license ends when your User Content is deleted from our systems, except to the extent we must retain limited copies for legal compliance, dispute resolution, security, and backups for a limited period.

5.3 Processing by third party providers

You acknowledge that Vix AI uses third party services, including Google and Fal AI, to process User Content and provide generation features. By using the Service, you consent to your User Content being transmitted to and processed by these providers as required to deliver the Service.

6. Acceptable use

You agree not to misuse the Service. You must not, and must not attempt to:

  • Upload, process, or generate content that violates applicable law or infringes intellectual property, privacy, or publicity rights.
  • Upload content containing sensitive personal data unless you have the lawful right and necessary consents to do so.
  • Use the Service for scams, phishing, malware, or other harmful or deceptive activity.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code, underlying prompts, models, or system components, except to the extent permitted by law.
  • Circumvent credits, entitlements, access controls, or security measures.
  • Use automated scripts, bots, or scraping to extract outputs at scale or overload the Service without our written permission.
  • Interfere with or disrupt the Service or its infrastructure.

We may suspend or terminate access for prohibited use.

7. AI output limitations and your responsibility

The Service may generate content that is inaccurate, incomplete, misleading, or unsuitable for certain uses. You are responsible for reviewing and verifying outputs before publishing, sharing, or relying on them.

You agree not to use outputs as a substitute for professional advice, including legal, medical, financial, or regulatory advice.

8. Intellectual property

The Service, including its software, design, branding, and underlying technology, is owned by Vix AI or its licensors and is protected by applicable intellectual property laws.

Except for the limited rights expressly granted to you, no rights are granted under these Terms.

9. License to you

Subject to your compliance with these Terms, Vix AI grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your internal purposes.

You may not resell the Service, offer it as a bureau service, or provide access to it to third parties as part of a competing product without our written permission.

10. Third party services

The Service may incorporate or depend on third party services such as Google, Apple, and Fal AI. Those third parties may have their own terms and policies. Vix AI is not responsible for third party services outside our control.

11. Account deletion

You may delete your account using the in app account deletion feature. Deleting your account will remove access to your account and may delete associated data in accordance with our Privacy Policy, subject to limited retention for legal compliance, security, and fraud prevention.

Account deletion does not automatically cancel your Apple subscription. You must cancel your subscription separately through your Apple ID subscription settings.

12. Service availability and changes

We do not guarantee uninterrupted availability. The Service may be unavailable due to maintenance, updates, outages, or factors beyond our control.

We may modify, suspend, or discontinue all or part of the Service at any time. If we discontinue paid features, we will handle access in a commercially reasonable manner consistent with Apple’s policies.

13. Termination

13.1 Termination by you

You may stop using the Service at any time. To stop subscription renewals, cancel through your Apple ID subscription settings. You may also delete your account in app.

13.2 Termination by us

We may suspend or terminate your access immediately if:

  • You violate these Terms
  • Your use poses a security, legal, or abuse risk
  • We are required to do so by law

Upon termination, your right to use the Service ends. Credits are not refundable and do not convert to cash.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that outputs will be accurate, reliable, or suitable for your intended purpose.

15. Limitation of liability

To the maximum extent permitted by law:

  • Vix AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities.
  • Vix AI’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Vix AI through Apple for the Service in the three months immediately preceding the event giving rise to the claim, or USD 10 if you paid nothing, whichever is greater.

Some jurisdictions do not allow certain limitations. In that case, these limitations apply to the greatest extent permitted.

16. Indemnity

You agree to indemnify and hold harmless Vix AI and its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your User Content
  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, excluding conflict of laws rules.

Unless mandatory consumer protection laws provide otherwise, you agree that disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in Ankara, Türkiye.

18. Apple, App Store, and EULA note

If you access the Service through Apple’s App Store, you acknowledge that:

  • Apple is not a party to these Terms, except as a third party beneficiary to the extent set out in Apple’s requirements.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any conflict between these Terms and Apple’s usage rules or App Store terms, Apple’s rules may apply to the extent required.

19. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above. If changes are material, we may provide additional notice within the Service.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
